Terms of Service

1. Eligibility

To use Bet App, you must be at least 18 years of age, a resident of the United States, and capable of forming a binding contract. You must verify a valid US phone number to access the Service. By using Bet App, you represent and warrant that you meet all eligibility requirements.

2. Nature of Service

Bet App is a personal commitment and accountability platform. You set goals for yourself, back them with a financial Stake, and report your own results. Bet App is not a gambling service, sportsbook, or prediction market. All commitments are self-directed and self-reported.

3. Accounts

You must create an account to use the Service. You must be at least 18 years of age. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may optionally enable two-factor authentication (SMS or authenticator app) for additional security. You may only maintain one account. If you delete your account, personally identifiable information will be anonymized; commitment and transaction records are retained as described in our Privacy Policy for legal and regulatory purposes.

4. How Commitments Work

A commitment is a personal goal you set within the app. You define what you will accomplish and select a duration of anywhere from 1 to 21 days (with 1-week, 2-week, and 21-day presets for convenience). You may have up to 5 active commitments at any time. Commitments may be created solo or as part of a Commit Together group, in which invited friends join the same goal and duration, each with their own independent Stake.

5. How Stakes Work

Each commitment is backed by a Stake ranging from $5 to $5,000, subject to progressive limits designed to help you build confidence through small wins before pursuing larger goals:

• Tier 1 (new users): up to $500 per commitment (total across all active commitments)
• Tier 2 (unlocked after $100 or more in total successful Stake completions): up to $5,000 per commitment (total across all active commitments)

When you create a commitment, your payment method is saved on file for the Stake amount. No charge is made and nothing is held. If you report that you kept your commitment, you are not charged and no money is collected. If you report that you faltered, you confirm the charge — including, on supported devices, a Face ID, Touch ID, or device-passcode confirmation — and only then is the Stake charged to your saved payment method. There are no processing fees.

Your saved payment method may be a credit or debit card you enter directly, or a card linked through Apple Pay or Google Pay. In every case the card is saved off-session (no charge, no hold) and is only charged on a self-reported falter, exactly as described above.

You may cancel an active commitment at any time; your payment method is not charged. Cancelled commitments do not count toward your stats or tier progression.

In Commit Together groups, each participant’s Stake is independent and is handled exactly as described above. No portion of any Stake is ever paid to another user.

6. Honor System

Bet App operates on an honor system. You are solely responsible for honestly reporting whether you kept or faltered on your commitments. By using the Service, you agree to report your results truthfully and in good faith.

7. Reporting Window

After a commitment’s duration ends, you have a 7-day window to report your result. If you do not report within this window, the commitment is considered “Forfeited” and no charge is made.

8. Disputes

If you believe a charge was made in error, please contact us at service@betonyouapp.com. We will review your case and work with you to resolve the issue. Because a Stake is charged only after you report that you faltered, Stake charges are generally non-refundable once made, except where we determine a charge resulted from a genuine error or technical fault. Any refund we issue is returned to your original payment method.

9. Payments

All payment processing is handled by a third-party, PCI-compliant payment processor. By using the Service, you agree to the applicable processor’s terms of service. Your payment method is saved on file and charged only if you report that you faltered; charges are processed through the processor’s secure infrastructure. Bet App does not store your full payment card details.

Tips. The Service allows you to leave optional, voluntary tips to support Bet App LLC. Tips are never required to use the Service and are not a payment for any product, feature, upgrade, or service — a tip unlocks nothing and has no effect on your commitments, stakes, or experience. Tips are charged to your payment method at the time you authorize them and are not held. Because a tip is a voluntary gift rather than a payment for goods or services, tips are non-refundable; however, at our discretion we may correct an obvious error, such as a mistyped amount. Tips are income to Bet App LLC.

10. Anchor

You may optionally elect one “Anchor” for a commitment — a real-life person who confirms, at the end, whether you followed through. Electing an Anchor sends them an email invitation; they choose whether to accept and how often they hear from us, and they may decline or unsubscribe at any time.

An Anchor never receives money and never pays anything. An Anchor’s role is limited to confirming an outcome, and their verdict can only affect the timing of a possible charge — for example, deferring it, asking you to make a final confirmation, or opening a dispute. An Anchor can never cause you to be charged when you report that you kept your commitment, and can never prevent a charge once you yourself report that you faltered. The only thing that ever results in a charge is your own honest report that you faltered.

If you and your Anchor disagree about the outcome, each of you may submit a final answer together with written reasoning, and that written reasoning is shared with the other person so the disagreement can be resolved. Your own final answer is what determines whether a charge is made.

11. In Your Corner (Support Contacts)

You may optionally add support contacts (“In Your Corner”) — people you invite by email to cheer you on and to be notified if you fall behind. Adding a contact saves their name and email only; no email is sent until you elect that contact on a specific commitment, and even then only after they expressly confirm the invitation. By adding a support contact, you confirm you have a personal relationship with them and reasonably believe they would welcome the invitation.

Support contacts receive only limited information that you control: your username, your goal, missed check-in counts (if you enable falling-behind notifications), and goal completion (if you enable success notifications). Support contacts are never told about faltered outcomes, charges, cancellations, or payment details. Every email includes an unsubscribe link, and a contact who unsubscribes will not be emailed again.

12. Commit Together

You may invite friends to commit to the same goal and duration as part of a “Commit Together” group. Each participant chooses their own independent Stake, which is handled exactly as described in Section 5. No money ever moves between users — no portion of any Stake is ever paid to another participant, and there is no prize, pot, or shared pool of money of any kind. Group members can see each other’s check-ins and final results, but never each other’s Stake amounts.

If the person who created a group purchased Go Serious (Section 13) for it, the day-by-day plan may be shared with the group so everyone can follow it. Sharing a plan with your group does not charge the other participants anything for Go Serious.

13. Go Serious (Optional Paid Feature)

“Go Serious” is an optional, paid planning feature that lets you define a specific goal for each day of a commitment. It is purchased as a one-time, per-commitment in-app purchase through the Apple App Store or Google Play (not through our card-on-file payment processor), and is separate from your Stake. Purchasing Go Serious is buying access to a planning feature; it is not a Stake, is not put at risk against your behavior, and does not change how your Stake works. Go Serious is available only on commitments of at least five (5) days.

Each Go Serious purchase gives you one reusable in-app credit that is applied when you add Go Serious to a commitment. If you cancel that commitment early — before you are halfway through it (measured in whole days elapsed from the commitment’s start) — the credit is restored to your account so you can apply Go Serious to a future commitment. If you cancel once you are at least halfway through, the credit is forfeited. This restoration returns the in-app credit only; it is not a refund of money, and any monetary refund of the App Store or Google Play purchase itself is governed solely by Apple’s or Google’s refund policies. A plan shared with you through Commit Together is free and carries no credit to restore.

Go Serious plans are general informational suggestions only — not professional, medical, fitness, nutritional, financial, investment, tax, or legal advice. Some plans are created by other users and are not reviewed, endorsed, or verified by us. By using Go Serious, you confirm that you are making your own decisions, doing only what is safe and appropriate for you, and taking part entirely at your own discretion. We recommend consulting a qualified professional before starting any plan — including, where relevant, a physician before any exercise, diet, fasting, or breathing goal, and a licensed financial professional before acting on any money-related goal. You assume all risk arising from following any Go Serious plan, and Bet App LLC is not responsible for outcomes resulting from plans you choose to follow.

14. Go Serious Community Plans

Go Serious plans are private by default. You may optionally choose to share a plan so other users can discover and use it. If you share a plan, the plan’s contents and a pseudonymous username are publicly visible to other signed-in users; do not include personal, private, or identifying information in a plan you share.

When publishing or sharing any plan, you agree not to submit content that is profane, harassing, hateful, sexually explicit, harmful, misleading, unlawful, off-topic, or otherwise inappropriate. We use automated filtering and user reporting to moderate shared plans; a plan is automatically hidden after a small number of reports, and we may remove shared content or restrict sharing at our discretion. Plans created by other users are not reviewed or verified by us, and the disclaimers in Section 13 apply to every plan you view or use, whether or not you purchase Go Serious.

You retain ownership of any plan you create. By choosing to share a plan, you grant Bet App LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to host, store, reproduce, display, distribute, and promote that plan within and in connection with the Service, with no compensation owed to you. This license is what allows other users to discover, view, and adopt your shared plan, and it survives the closure or deletion of your account; if you delete your account, your shared plans remain available but are re-attributed to a generic, non-identifying byline.

15. Profile Pictures

You may optionally add a profile picture. If you do, it is visible to users with whom you are connected as accepted friends. You are responsible for the content of any image you upload and must not upload images that are unlawful, infringing, sexually explicit, hateful, or otherwise inappropriate, or that depict anyone without their consent. Connected users can report a profile picture, and a reported picture is automatically removed after a small number of reports. We may remove any image at our discretion.

16. App Store and In-App Purchase Terms

The Service is distributed through the Apple App Store and Google Play. Your use of the app is also subject to the applicable store’s terms, including Apple’s Licensed Application End User License Agreement and Google Play’s Terms of Service. In-app purchases (such as Go Serious) are processed by Apple or Google under their terms, and refunds for in-app purchases are handled according to the applicable store’s refund policies. Apple and Google are not parties to these Terms and are not responsible for the Service. Stakes and tips are real-world charges processed by our card-on-file payment processor and are not in-app purchases.

17. SMS Communications

By providing your phone number and using the Service, you consent to receive SMS messages from Bet App for account verification and security purposes. Message and data rates may apply. Message frequency varies based on account activity (typically 1-2 messages during signup and 1 per login if SMS two-factor authentication is enabled).

You may opt out at any time by replying STOP to any message. For help, reply HELP or contact service@betonyouapp.com. Opting out of SMS may limit your ability to use certain security features.

18. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Bet App LLC and are protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

19. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Create multiple accounts or use another person’s account
• Attempt to manipulate, exploit, or abuse the commitment or payment systems
• Falsely report a commitment result, including reporting a success you did not earn
• Publish profanity, harassing, hateful, explicit, harmful, or off-topic content in shared Go Serious plans, profile pictures, usernames, or any other public-facing field
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems, bots, or scripts to access the Service
• Harass, threaten, or harm other users

20. Account Suspension

We reserve the right to suspend or permanently terminate your account at our sole discretion for violations of these Terms, including but not limited to prohibited conduct. Because a Stake is only ever charged after you yourself report that you faltered, initiating a chargeback on such a charge may result in suspension of your account pending review. If you believe a charge was made in error, please contact us first at service@betonyouapp.com so we can resolve it directly. We may decline to reinstate accounts suspended for fraud or abuse.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Bet App LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Service. Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

22. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

23. Indemnification

You agree to indemnify, defend, and hold harmless Bet App LLC and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

24. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Wyoming, and you consent to personal jurisdiction and venue in such courts.

25. Termination

You may terminate your account at any time by deleting it through the app. Upon deletion, personally identifiable information is anonymized; commitment and transaction records are retained for legal and regulatory purposes as described in our Privacy Policy. We may also terminate or suspend your access to the Service at any time, with or without cause, with or without notice. No saved payment method will be charged as a result of termination.

26. Dispute Resolution and Arbitration

You and Bet App LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court.

You and Bet App LLC each waive the right to a jury trial and the right to participate in a class action, class arbitration, or other representative proceeding. Arbitration shall take place in the State of Wyoming or, at your election, by phone or video conference. The arbitrator’s decision shall be final and binding.

This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against us on your behalf. You may also bring claims in small claims court if your claims qualify.

You may opt out of this arbitration agreement by sending written notice to service@betonyouapp.com within 30 days of first agreeing to these Terms. If you opt out, disputes will be resolved in the courts of Wyoming as specified in Section 24.

27. Your Data Rights

You have the right to request a copy of all personal information we hold about you in a portable, machine-readable format (JSON). You may also request correction or deletion of your personal information. For full details on your data rights, please see our Privacy Policy. 28. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the app or by other appropriate means. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

29. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bet App LLC regarding the Service and supersede any prior agreements on that subject. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
